Q: Can I get a DUI if I sit in my car after drinking a few beers?

A: Yes, under Massachusetts law an OUI requires a person be in “actual physical control” of a vehicle. Driving a vehicle is not required. If you sit in or near a car with your keys in the ignition you are unnecessarily exposing yourself to a possible DUI arrest. Many legal issues arise out of “actual physical control” arrests which is why an experienced DUI attorney is important.
