Q: Can I get a DUI if I sit in my car after drinking a few beers?

A: Yes, under Massachusetts law an OUI requires a person be in “actual physical control” of a vehicle. Driving a vehicle is not required. If you sit in or near a car with your keys in the ignition you are unnecessarily exposing yourself to a possible DUI arrest. Many legal issues arise out of “actual physical control” arrests which is why an experienced DUI attorney is important.

If you were arrested while sleeping off a few drinks in your car and you are now in need of legal representation don’t hesitate to call us. It is in your best interest to act quickly to preserve your driving privilege and fight your OUI charges.

Q: I was arrested for a first time an OUI when I visited Massachusetts but I reside out of state. Can I complete any of the mandatory sanctions for the OUI in my home state so that I don’t have to return to Massachusetts?

A: Many of the mandatory sanctions for a first-time OUI can be completed in your home state if you or your attorney informs the court that you do not reside in Massachusetts. Please discuss how these sanctions apply to the specifics of your case with an experienced Massachusetts OUI attorney.
